This includes both personal information used, such as identification features (e.g. name, address and date of birth), external features or inner states, but also factual information, such as financial circumstances and ownership structures and all other relationships of the data subject to third parties and his or her environment.
Use of Our Website
Purely Informational Website Use
When you use our website, information is collected about you, without this requiring any direct contact or any registration. In this context, we automatically gather information via our IT system about your usages behaviour and your interaction with us and registered data concerning your computer or mobile device. This especially relates to the following technical data, which is transferred by your browser to our server:
- IP address of the requesting computer;
- date and time of the request;
- time zone difference to the Greenwich Mean Time (GMT);
- content of the request (specific web page);
- access status / HTTP status code;
- respective transferred data volume;
- website from which the request originates;
- operating system and its interface;
- language and version of the browser software.
The legal basis for data processing is Art. 6 No. 1 sentence 1 letter f GDPR. We collect the aforementioned data, since it is technically required to ensure error-free provisioning of the website and to enable us to display our website to you. This also constitutes our legitimate interest.
In addition, cookies are used when our website is accessed. Cookies are text files which are placed on the hard drive of your computer when our website is visited and are stored by your browser. Cookies cannot execute programmes or transmit viruses to your computer. Their purpose is to make the website more user-friendly and effective overall. Moreover, they serve to identify the user, contain information about websites accessed and transmit such information to the entity by which the cookie was placed.
This website uses the following types of cookies, the scope and functionality of which are explained below: (1) transient cookies and (2) persistent cookies.
Transient cookies are automatically erased when you close the browser. These include, in particular, session cookies. They retain a session ID, with which various requests from your browser can be assigned to the common session. This will allow your computer to be recognised if you return to our website. Session cookies are erased once you close the browser.
Persistent cookies are erased automatically after a pre-defined period, which can be different depending on the cookie. You can erase the cookies in the security settings of your browser at any time.
You can configure your browser setting according to your preferences and refuse acceptance of third-party cookies or all cookies, for example. Please note that, in this case, you may not be able to use all of the functions of this website.
Use of Google Analytics
Where IP anonymisation is enabled on this website, however, your IP address is abbreviated beforehand by Google in member states of the European Union or in other signatory states to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the US and abbreviated there. Google uses this information on our behalf to analyse your use of the website, to compile reports about the website activities and to provide other services relating to the use of the website and the Internet to the website operator.
The IP address transmitted from your browser as part of Google Analytics is not amalgamated with other data from Google. By setting your browser software accordingly, you can prevent cookies from being retained; however, we point out that you may not have full access to all website functions in this case. In addition, you can prevent the data generated by the cookie and relating to your use of the website (incl. your IP address) from being transmitted to and being processed by Google by downloading and installing the browser plug-in available at the following link: http://tools.google.com/dlpage/gaoptout?hl=en.
This website uses Google Analytics with the extension “_anonymizeIp()”. As a result, IP addresses are processed in shortened form, thus excluding reference to a particular individual. Where the data collected about you is assigned a personal reference, it is immediately excluded, and the personal data thus erased immediately.
We use Google Analytics to analyse and make regular improvements to the use of our website. With the statistics that we obtain, we can improve our offering and make it more interesting for you as user. This also constitutes our legitimate interest in the use of Google Analytics. The legal basis for the use of Google Analytics is Art. 6 No. 1 sentence 1 letter f GDPR.
For exceptional cases in which personal data is transferred to the US, Google has agreed to comply with the EU-U.S. Privacy Shield, https://www.privacyshield.gov/EU-US-Framework.
Use of YouTube Videos
We have embedded YouTube videos in our website which are stored at http://www.YouTube.com and can be played directly on our website. (Image) links to these videos have been embedded in our website. No data about you as a user is transferred to YouTube if you do not play the videos. The data specified in the following paragraph is not transferred before you play the videos. We have no control over such data transfer.
By playing the videos on our website, YouTube receives information that you have accessed the relevant sub-page of our website. Moreover, the data specified in the “Collection and Retention of Personal Data” section of this policy is transferred. This happens regardless of whether a YouTube user account exists into which you are logged in or whether no user account exists. If you are logged into Google, your data is associated directly with your account. If you do not want the data to be associated with your YouTube profile, you must log out before activating the button. YouTube retains your data as user profiles and uses it for the purposes of advertising, market research and/or the custom configuration of its website. Data (including data of users who are not logged in) is evaluated in this way, in particular, to provide custom advertising and to inform other users of the social network about your use of our website. You have the right to object to the creation of such user profiles; if you intend to exercise this right, please contact YouTube.
Our website contains AddThis plug-ins. These plug-ins enable you to set bookmarks or to share interesting contents with other users. By using the plug-ins, we provide you with the opportunity to interact with the social networks and other users, so that we can improve our website and make it more interesting for you as user. The legal basis for the use of the plug-ins is Art. 6 No. 1 sentence 1 letter f GDPR.
By using the AddThis plug-ins, your web browser establishes a direct connection to the servers of AddThis and, where appropriate, the selected social network or bookmarking service. The recipients are informed that you have accessed the corresponding page of our website and receive the data specified in the “Collection and Retention of Personal Data” section of this policy. This information is processed on the AddThis servers in the US. We have agreed on standard data protection clauses with AddThis. Where you send contents on our website to social networks or bookmarking services, a connection can be made between the visit to our website and your user profile at the corresponding network. We have neither influence on the collected data and data processing procedures nor are we aware of the full scope of the data collection, the processing purposes and the retention periods. We also do not have any information on the erasure of the data collected by the plug-in provider.
The plug-in provider retains this data as user profiles and uses it for the purposes of advertising, market research and/or the custom configuration of its website. Data (including data of users who are not logged in) is evaluated in this way, in particular, to provide custom advertising and to inform other users of the social network about your use of our website. You have the right to object to the creation of such user profiles; if you intend to exercise this right, please contact the respective plug-in provider.
If you do not want to be part of this process, you can object to the data collection and retention at any time with effect for the future by setting an opt-out cookie: www.addthis.com/privacy/opt-out. Alternatively, you can set you browser in such a way that it prevents the setting of cookies.
For more information on the purpose and scope of the data collection and its processing by the plug-in provider and for more information on your related rights and setting options to protect your privacy, please refer to: AddThis LLC, 1595 Spring Hill Road, Suite 300, Vienna, VA 22182, USA, www.addthis.com/privacy.
We use map sections of the “OpenStreetMap” service on our website (https://www.openstreetmap.de). OpenStreetMap is an open source mapping tool; the maps are offered based on the Open Data Commons Open Database licence (ODbL) by the OpenStreetMap Foundation (OSMF).
We use OpenStreetMap based on Art. 6 No. 1 sentence 1 letter f GDPR; we have a legitimate interest in such data processing, as it serves to improve the user-friendliness of our website.
We use the Google Maps map service on our “PureAir” sub-pages (www.bauerpureair.com) to display geographic information. Google Maps is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. When Google Maps is used, Google also collects, processes and uses data on the use of the Google Maps functions by visitors of the websites. By using this website, you agree to the collection, processing and use of the automatically collected data by Google Inc., its representatives and third parties.
Google Maps is used to ensure an appealing representation of our online offers and easy finding of the places specified by us on the website. This is a legitimate interest in the sense of Art. 6 No. 1 sentence 1 letter f GDPR.
Specific Establishment of Contact
Where you contact us using the e-mail address specified above or other means, we retain the information provided by you to process any request or follow-up questions. This also constitutes our legitimate interest in processing your data acc. to Art. 6 No. 1 sentence 1 letter f GDPR.
Use of a Contact Form
When you contact us using one of the contact forms provided on our website, the data provided by you, your first name and surname, gender and e-mail address, is processed. In addition, all other data entered by you in the form as part of the contacting process is retained and processed to such extent that it will be possible to identify you, process your request and answer your questions. This also constitutes our legitimate interest in processing your data acc. to Art. 6 No. 1 sentence 1 letter f GDPR.
The data transferred to us by using the contact form is secured by SSL encryption.
Once the enquiries you made have been resolved in full, the personal data collected by us in the context of a use of the contact form is erased automatically, unless any statutory retention obligations apply. Such data is neither used for any other purpose nor disclosed to third parties.
Using our customer login, you can view additional documents. To access this section, you must contact us and fill out the contact form provided on this website to that end. We will then send you by e-mail the information required for the customer login, i.e. user name and password. The foregoing under “Use of a Contact Form” applies accordingly.
We provide you with the opportunity to use our dealer login on our “PureAir” sub-pages (www.bauerpureair.com). The dealer login enables you as a dealer to award the “Bauer PureAir Certificate” to your customers. A dealer account can be created only after certification training has been completed in our company and only based on your personal data. We process your personal data to complete “certification orders” by you. The legal basis here is Art. 6 No. 1 sentence 1 letter f GDPR.
To ensure your proper registration and to prevent unauthorised registrations by third parties, you will receive your personal access data by e-mail once your account has been created. We will store in our system the data transferred by you, subject to withdrawal, only after the registration has been successful.
You can have us delete an account once set up at any time without incurring any costs other than the transmission costs according to the basic tariffs. If you wish to do this, notification in text form to the contact data stated under the “Controller” section (e.g. e-mail, fax, letter) is sufficient. In this case, we will erase your stored personal data, unless we must continue to store them to fulfil agreements or due to statutory retention obligations.
Online Training Registrations
Data is also processed as part of the online registration for the training seminars offered by us. The data entered by you in the registration form provided on this website is saved in order to carry out the corresponding order. In this context, the collected data is also forwarded to third parties, especially if, besides the registration for the training seminar, you have also made a hotel reservation. This forwarding is necessary to carry out your order. This is our legitimate interest. The legal basis here is Art. 6 No. 1 sentence 1 letter f GDPR.
Data Forwarding to Third Parties
In general, we use your personal data only within our company. If and insofar as we engage third parties to fulfil contracts, these will only receive personal data to the extent necessary for providing the corresponding service. This is the case where the data must be forwarded to partner companies due to your order, your request or to meet a contractual obligation. Such partner companies may also be located outside the EU.
Where we outsource certain parts of data processing (“commissioned data processing”), we oblige the contracted data processor by contract to only use personal data in accordance with the provisions of data protection law and to guarantee the protection of the rights of the data subject.
Any transfer of data to bodies or persons outside the EU, other than in cases as listed in this policy, does not take place and is not intended.
Furthermore, the general retention period of your personal data may exceptionally be up to 30 years where this is necessary for the establishment, exercise or defence of legal claims.
