On this website, we provide you with information on the data protection provisions applicable to this app. These data protection provisions exclusively apply to this app, not to the online presence of BAUER KOMPRESSOREN and our affiliated companies. In this privacy policy, you can find more information about the data collected when the app is used and the purposes of our processing of such data. Furthermore, we inform you about the rights you have due to the described data collection and processing. The legal basis here is the General Data Protection Regulation (“GDPR”), whose regulations have been applicable since 25/05/2018. These rules do not only extend the already existing rights to data protection and security, but also improve the protection of personal data.

The BAUER GROUP (BAUER KOMPRESSOREN and affiliated companies) is a globally operating group of companies comprising many national branches and subsidiaries. Please note that, due to our worldwide web presence and the global orientation of our business activities, your electronically gathered personal data may be transported within the BAUER Group across geographical boundaries into countries with different data protection provisions.

3. Collection and Retention of Personal Data

Acc. to Art. 4 No. 1 GDPR, personal data means any information relating to an identified or identifiable natural person (“data subject”). This includes both personal information used, such as identification features (e.g. name, address and date of birth), external features or inner states, but also factual information, such as financial circumstances and ownership structures and all other relationships of the data subject to third parties and his or her environment.

4. Use of the App

This app may be used without any customer registration or set-up of a customer account with us. No personal data will be retained or transferred to us.

The optional use of the “Remote” menu item does not require any registration in the app either. Use implies, however, that the customer has a compressor with an appropriate B CONTROL MICRO compressor control and connects it to a local network. It is the customer’s responsibility to provide the local network and to comply with recommended security settings. We do not have any influence thereon.

Communication between B-CONTROL MICRO and this app requires a router in a local network or a direct ad-hoc connection. In doing so, the B-CONTROL MICRO compressor control sends data of the compressor, e.g. operating pressures, operating temperatures, compressor status, maintenance condition, etc., to the app. The compressor data will be neither permanently retained in the app nor transferred to us. The B-CONTROL MAC address, the IP address and the password will only be stored in the app to identify the compressor and for recurring connection set-up to the compressor.

5. Contacting per E-Mail

If you send us requests by e-mail, your particulars from your e-mail including the contact details indicated therein by you will be retained with us. This serves to process any request or follow-up questions. We will not forward the data without your consent. The legal basis for processing of such data is our legitimate interest in processing your request acc. to point (f) of Art. 6(1) GDPR and, if applicable, point (b) of Art. 6(1) GDPR, where your request aims to conclude a contract. Once your request has been processed conclusively, your data will be erased, unless legal retention obligations stipulate otherwise. Any use for any other purpose or any data transfer to third parties will not take place.

Where you contact a dealer by e-mail using the dealer locator (section “Worldwide”) and the e-mail addresses indicated there, your particulars from your e-mail will be forwarded to the respective dealer; no data will be retained with us in that respect. We have no influence over the processing and/or retention by the dealer. In that respect, we refer to the privacy policy of the respective dealer.

6. Social Media Links

We maintain an online presence in the Facebook and Instagram social networks. They serve to inform the users of these networks about us and our products and to communicate with the users. Only links to the social networks have been integrated into this app. After clicking on the link in the menu, you will be forwarded to the provider’s website (Facebook or Instagram). User information will be transferred to the respective provider only after such forwarding. Once the networks are accessed, the terms of use and data protection provisions of the respective network provider apply. Unless otherwise specified as part of this privacy policy, we process the data of the users of the respective network where the user communicates with us within the network

7. Use of YouTube and Youku Videos

We have embedded YouTube videos in our app which are stored at www.YouTube.com and can be played directly from our app. Our app contains links to these videos.

Data will be transferred to YouTube only after the respective subsection in the app containing the integrated videos has been accessed. We have no control over such data transfer.

By playing the videos in our app, YouTube receives information that you have accessed the relevant sub-page of our app. Moreover, the data specified in the section “3. Collection and Retention of Personal Data” of this policy is transferred. This happens regardless of whether a YouTube user account exists into which you are logged in or whether no user account exists. If you are logged into Google, your data is associated directly with your account. If you do not want the data to be associated with your YouTube profile, you must log out before activating the button. YouTube retains your data as user profiles and uses it for the purposes of advertising, market research and/or the custom configuration of its website. Data (including data of users who are not logged in) is evaluated in this way, in particular, to provide custom advertising and to inform other users of the social network about your use of our app. You have the right to object to the creation of such user profiles; if you intend to exercise this right, please contact YouTube.

Google also processes your personal data in the US and has agreed to comply with the EU-US Privacy Shield, https://www.privacyshield.gov/EU-US-Framework.

If you use our app in the Chinese language area and outside the Chinese language area if the YouTube offering is not available (e.g. due to technical issues), we will use videos of the company Youku. The provider is Youku Tudou Inc., SinoSteel Plaza, 11th floor, 8 Haidian Street, Haidian District, Beijing, 100080 China. If you play one of the videos integrated via Youku, a connection will be established to the Youku servers. In this respect, the Youku server will be informed about which of our pages you have visited. Additionally, your IP address will be transferred to Youku. This also applies if you are not logged in to Youku or do not have a Youku account. The information gathered by Youku will be transmitted to the Youku server. If you have and are logged in to a Youku account, you allow Youku to match your browsing behaviour directly with your personal profile. You can prevent this by logging out of your Youku account.

8. Google Maps

This app uses the Google Maps map service to display geographic information. Google Maps is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. When Google Maps is used, Google also collects, processes and uses data on the use of the Google Maps functions by visitors of the app. By using this app, you agree to the collection, processing and use of the automatically collected data by Google Inc., its representatives and third parties.

Google Maps is used to ensure an appealing representation of our online offers and easy finding of the places specified by us on the app. This is a legitimate interest in the sense of Art. 6 No. 1 sentence 1 letter f GDPR.

9. Evaluation by MixPanel

This app uses the MixPanel analysis service. MixPanel is a service of MixPanel Inc., 405 Howard St., Floor 2, San Francisco, CA 94105, USA. Using MixPanel, we can collect and evaluate statistical data on how this app is used. This means that events are logged within the app. To this end, log data will be transferred to MixPanel. Such transfer is based on a pseudonymised tracking ID of the smartphone/tablet used; the device ID will not be used. The pseudonymised user profiles will not be amalgamated with personal data of the bearer of the pseudonym. More detailed information on the use of your data can be found on the English-language privacy page of the MixPanel service at mixpanel.com/privacy. In line with the EU provisions on data protection, any conclusion to the individual user is excluded for both us and MixPanel.

We will use the data collected using MixPanel to improve and optimise the functions of the app and to design the app in an even more interesting and useful manner for the user.

If you do not want any log data of events to be transferred within the app, you may object to the transfer and retention of such data for the future. To this end, the checkbox at the end of this Privacy Policy must be disabled.

10. Data Forwarding to Third Parties

In general, we use your personal data only within our company. If and insofar as we engage third parties to fulfil contracts, these will only receive personal data to the extent necessary for providing the corresponding service. This is the case where the data must be forwarded to partner companies due to your order, your request or to meet a contractual obligation. Such partner companies may also be located outside the EU.
Where we outsource certain parts of data processing (“commissioned data processing”), we oblige the contracted data processor by contract to only use personal data in accordance with the provisions of data protection law and to guarantee the protection of the rights of the data subject.
Any transfer of data to bodies or persons outside the EU, other than in cases as listed in this policy, does not take place and is not intended.

11. Rentention Period

Unless otherwise specified in this privacy policy, we erase your personal data stored by us once the purpose for which we have gathered your data ceases to exist. This does not apply only where we are obliged to retain data for longer periods acc. to s. 1 of point (c) of Art. 6(1) GDPR due to retention and documentation obligations under tax and commercial law (from the German Commercial Code, the German Criminal Code or the Fiscal Code of Germany). In this case, your personal data is erased after ten years at the latest. Your personal data will be further retained only where you have given your voluntary consent acc. to s. 1 of point (a) of Art. 6(1) GDPR.
Furthermore, the general retention period of your personal data may exceptionally be up to 30 years where this is necessary for the establishment, exercise or defence of legal claims.

12. Your Rights as Data Subject

According to the applicable laws, you have various rights concerning your personal data. If you would like to assert such rights, please direct your enquiry by e-mail or mail to the address provided in the “Controller” section and clearly identify yourself.
Right of Confirmation and Access
You have the right to access to clear information about the processing of your personal data. In detail, this means that you receive a confirmation from us as to whether personal data about you is processed. If this is the case, you have the right to obtain from us access to information regarding the personal data stored and a copy of such data.
Right to Rectification
You have the right to request from us the rectification and, where appropriate, also completion of your personal data.
Right to Erasure (“Right to be Forgotten”)
Acc. to Art. 17 No. 1 GDPR, you have the right to request from us the erasure of your personal data.
